FIXED-TERM WORK

 

FIXED-TERM WORK The fixed-term work is a contract where the expiry date is clearly shown. If the date is not shown it can be inferred from the reason of the relation, for example the realization of a work.

CHARACTERISTIC OF THE CONTRACT The contract must be written and it must have a fixed or inferred length, but it cannot be longer than three years. The contract which is shorter than three years can be extended only once and for reasons related to the activity carried out, but the total length of the two contracts must be three years.

EXPIRY The employer who does not interrupt the business relation at the expiry of the contract is obliged to give the worker an increase of the amount due up to :
-  20% for every additional day up to the tenth day ;
-  40% for every following day.

The extention of the contract beyond the expiry date involves the change of this contract into a permanent long-term if :
-  the extension exceeds twenty days and the length of the contract is less than six months ;
-  the extension exceeds thirty days and the length of the contract is more than six months ;

RIGHTS OF THE WORKERS The pay and regulations, duties being equal, cannot be less favourable as to the workers of the same level ; the fixed-term worker has the same rights as the permanent long-term worker as to holidays, thirteenth month’s salary, severance pay and any other treatment, according to the length of the contract. Every worker has the right to a training that can guarantee the efficent and safe course of his job

ODD JOBS The” odd job” is a business relationship which cannot last with the same employer more than 30 days during a solar year and it does not have to involve a pay higher than 5000 € with the same employer and in the same solar year. The odd job has, therefore, two restrictions : a time restriction and an economic restriction. The worker can be asked to perform any task and he is required neither to be put on any register nor to have a VAT registration number, since his pay is subject to a 20% withholding tax. If the annual income is higher than 5000 € the worker must enrol in the separate management of the collaborators.

INCIDENTAL ODD JOB The incidental odd job’s aim is to favour the working introduction of weak segments of the market, as for example students. The tasks for these workers could be : housework private additional education gardening and cleaning, making of sport, social and cultural events cooperation with public authorities and voluntary work organizations for solidarity or emergency activities

The incidental odd job : cannot be performed for more than 30 days during the solar year ( even if for different employers) the pay cannot be higher than 5000 € in a solar year those who are interested in doing these jobs must give their availability to the province authorities for the employment or to private and public bodies accredited at the regions that will give them a magnetic identification card, against payment. The worker will have to change the bonds in money , addressing to the qualified authorities. In the value of each bond national insurance contributions are included. The pay is tax-free and it does not weight on the unemployment condition.

JOB ON A PROJECT. The business relation for these jobs is related to the specific project. The characteristics of this contract are : the autonomy of the collaborator, the coordination with the client and the insignificance of the time used for the execution of the project. The worker can carry out this activity for more clients, ( unless otherwise steted in the individual contract) The contract must be written and it must show the length, the content, the amount due , how the worker and the client must work together and job security.

The early withdrawing can take place in case of a just cause . In case of illness or accident, the contract provides for a maximum period of absence of 30 days which are unpaid, for contracts with a definable expiry one sixth of the length for contracts with a fixed expiry.
